Amicus Brief Filed Supporting Doe Families
December 18th, 2010Rutgers Law Professor files amicus curiae (“friend of the court”) brief with Third Circuit Court of Appeals. On Monday, December 13, Professor Earl Maltz of Rutgers University – Camden Law School filed an amicus curiae (“friend of the court”) brief with the Third Circuit of Appeals. Prof. Maltz’s brief supports the position taken by Students Doe that the District Court erred in interpreting the ruling law, ruling the plan survived strict scrutiny because it served “compelling Government interest”, and erred in reaching the conclusion, based on no evidence, that a “color blind” plan could not have met the District’s “non-negotiables”.
